Construction-Related Legal Issues

Home Improvement Contractor Law

In Massachusetts, residential home improvement contractors are particularly susceptible to liability if they don't strictly adhere to the statutory requirements under Massachusetts General Laws (MGL) c. 142A, the Massachusetts Home Improvement Contractor Act ("the Act"). Homeowners can equally undermine their chances of obtaining financial relief under the guaranteed fund provided by the Act, if, for example, they deviate from the statutory mandates by filing for certain permits.

A violation of the Act is a per se violation of MGL c. 93A, the Massachusetts Consumer Protection Act, which provides for double or triple damages and the award of attorney's fees and costs if certain requirements can be met. This means that if a court finds that there has been a violation of any provision MGL c. 142A by the contractor, it automatically is a violation of MGL c. 93A. In addition, there are administrative and criminal penalties that can be asserted against the home improvement contractor for non-compliance.
